By visiting the Site, creating an account, submitting information, or placing an order, you agree to these Terms. If you do not agree with them, please do not use the Site or place an order.

Nothing in these Terms limits any mandatory rights you may have under applicable US consumer law.

Votara Tech is an online-only smart home gadget store. We do not operate a public retail storefront, showroom, customer collection point, or automatic return counter.

Product performance can vary depending on installation, environmental conditions, Wi-Fi signal strength, app compatibility, and the way the product is used. We do not guarantee that every product is suitable for every home or environment.

We may correct errors, inaccuracies, or omissions and update product information at any time. If a correction materially affects an order already placed, we will contact you where appropriate.

You are responsible for:

Pricing and Payments

All prices are displayed in US dollars ($), including applicable taxes where required by law, unless otherwise stated at checkout.

We may change product prices, promotions, bundle prices, product availability, or purchase limits before an order is accepted.

Payment must be made at checkout using an available payment method. By submitting payment information, you confirm that you are authorised to use the selected payment method and that the information provided is accurate.

If a pricing, shipping, discount, tax, inventory, or payment error affects an order, we may contact you to confirm whether you wish to proceed using the corrected information or cancel the affected order. If an order is cancelled after payment has been processed, the applicable amount will be refunded to the original payment method.

Orders and Acceptance

After you place an order, you may receive an email confirming that we received it. This acknowledgement does not necessarily mean that your order has been accepted.

Your order is accepted when we send a shipping confirmation or otherwise confirm acceptance in writing.

We may refuse, limit, or cancel an order before acceptance because of product unavailability, inaccurate product or pricing information, suspected fraud, unauthorised payment activity, incomplete delivery information, breach of these Terms, or restrictions imposed by payment providers or carriers.

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

Shipping and Delivery

Our Shipping Policy forms part of these Terms.

We currently offer shipping to customers in the United States.

Votara Tech currently offers the following shipping options:

Free Shipping

  • Estimated transit time: 5–8 business days
  • Cost: Free

Express Shipping

  • Estimated transit time: 3–5 business days
  • Cost: $4.99

Orders are normally processed within 1–2 business days, Monday through Friday, excluding public holidays. Processing time is separate from transit time.

Delivery estimates are estimates, not guaranteed delivery dates. Weather, carrier disruptions, public holidays, inaccurate delivery information, supply-chain conditions, and other circumstances outside our reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed delivery, or additional costs caused by inaccurate or incomplete address information provided at checkout.

Returns, Refunds, and Exchanges

Our Return & Refund Policy forms part of these Terms.

We offer a 30-day return window from delivery for most items. Details about eligibility, return costs, refund timing, and exceptions are set out in our Return & Refund Policy.

We do not charge restocking fees for returned items.

For confirmed damaged, defective, incomplete, incorrect, or materially misrepresented items, contact us as soon as reasonably possible after delivery so that we can review the issue and provide appropriate instructions.

Direct exchanges are not offered at this time. If you need another product, you may need to return an eligible item and place a new order.

Intellectual Property

All Site content, including text, product descriptions, photographs, graphics, logos, icons, designs, videos, product arrangements, and website layout, is owned by or licensed to Votara Tech.

You may view and download Site content for your personal, non-commercial use only.

Without our written permission, you may not copy, reproduce, distribute, publish, sell, license, modify, create derivative works from, or commercially use Site content.

You may not use our name, logo, product images, or brand elements in a way that suggests affiliation, endorsement, or partnership without our written permission.

User Content and Reviews

Nothing in this section limits mandatory consumer rights or legal protections that cannot be excluded.

Liability

We are liable without limitation where liability cannot be excluded or limited by law, including in cases of intentional misconduct, gross negligence, injury to life, body, or health, and liability under mandatory product-liability law.

In these cases, our liability is limited to foreseeable damage typical for the contract.

Nothing in these Terms excludes or limits liability for defective products, lack of conformity, or other consumer rights where an exclusion or limitation is prohibited by law.

Indemnification

You agree to compensate Votara Tech for claims, losses, liabilities, costs, and expenses arising from your unlawful use of the Site, violation of these Terms, violation of applicable law or third-party rights, or content you submit, to the extent permitted by applicable law.

This section does not limit rights you may have as a consumer under mandatory law.

Governing Law and Jurisdiction

These Terms and purchases made through the Site are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-law principles.

Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Kentucky, unless applicable law requires otherwise.

Nothing in these Terms restricts mandatory legal rights regarding jurisdiction.

We may update these Terms from time to time to reflect changes in our business, products, services, technology, or legal obligations.
